Terms of Service

These Terms of Service ("Terms") govern your use of DisputeDog ("DisputeDog," "we," "us," or "our"), including our website, dashboard, and related services (collectively, the "Service"). By creating an account, connecting a delivery platform, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The service

DisputeDog reviews payout and order data from third-party delivery platforms such as DoorDash and Uber Eats, identifies charges that appear to qualify for refund under each platform's policies, and files disputes through those platforms' standard dispute workflows on your behalf. We report outcomes back to you through the dashboard and periodic statements.

DisputeDog is an independent service. We are not affiliated with, endorsed by, or sponsored by DoorDash, Uber Eats, Grubhub, or any other delivery platform.

2. Eligibility and accounts

To use the Service, you must be at least 18 years old and authorized to act on behalf of the restaurant or business whose accounts you connect. You agree to provide accurate information, keep your contact details current, and protect your login credentials. You are responsible for all activity that occurs under your account.

3. Authorization

By connecting a delivery platform account, you authorize DisputeDog to:

  • Access payout reports, order details, and dispute history for the connected accounts.
  • File, amend, and follow up on disputes on your behalf through the platform's standard dispute process.
  • Communicate with the platform's support channels as needed to pursue a recovery.

You may revoke this authorization at any time by disconnecting the account in your dashboard or by emailing us. Revocation does not affect disputes already filed.

4. Pricing and payment

DisputeDog charges a performance-based fee equal to a percentage of the sales we successfully recover for you. Your specific rate is confirmed in writing during onboarding. There are no upfront fees, no monthly subscription fees, and no charges on disputes that do not result in a recovery.

Recovery is measured by the credits, refunds, or adjustments issued by the delivery platform in response to disputes we file. We invoice monthly. Invoices are due on receipt unless otherwise agreed in writing. Past-due balances may accrue interest at the lesser of 1.5% per month or the maximum permitted by law.

5. No guarantee of recovery

The outcome of any dispute is decided by the delivery platform under its own policies, not by DisputeDog. We do not guarantee that any specific charge will be refunded, that any specific dollar amount will be recovered, or that any specific timeline will be met.

6. Your responsibilities

You agree that you will:

  • Use the Service only for lawful purposes and in accordance with these Terms and the policies of any connected delivery platform.
  • Not file or instruct us to file disputes that you know to be false or unsupported.
  • Promptly inform us of any direct contact you receive from a delivery platform regarding a dispute we are working on.
  • Not reverse engineer, scrape, resell, or attempt to gain unauthorized access to the Service.

7. Intellectual property

The Service, including its software, design, content, and logos, is owned by DisputeDog and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect. You retain ownership of the data you provide and the data we collect from your connected accounts on your behalf.

8. Cancellation and termination

You may cancel at any time by disconnecting your accounts and notifying us. We may suspend or terminate your access if you violate these Terms, fail to pay invoices, or use the Service in a way that could harm DisputeDog, our other customers, or a delivery platform relationship. Fees apply to recoveries recognized before cancellation, including recoveries that arrive after cancellation but were tied to disputes filed beforehand.

9. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, DisputeDog disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will identify every recoverable charge or that any specific dispute will succeed.

10. Limitation of liability

To the maximum extent permitted by law, DisputeDog and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the fees you paid to DisputeDog in the six months immediately before the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless DisputeDog and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of disputes you instruct us to file that turn out to be unsupported, your violation of these Terms, or your violation of any third-party right, including any delivery platform's terms of service.

12. Governing law

These Terms are governed by the laws of the United States and the state in which DisputeDog is organized, without regard to conflict-of-law principles. Any dispute arising out of these Terms will be resolved in the state or federal courts located in that jurisdiction, and you consent to their personal jurisdiction.

13. Changes

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. If changes are material, we will give you reasonable notice, for example by email or an in-product banner. Continued use of the Service after the changes take effect means you accept the updated Terms.
